TERMS AND CONDITIONS OF SALE
(pursuant to Legislative Decree no. 206/2005 – Consumer Code, and Legislative Decree no. 70/2003)

1. Introduction and Effectiveness of the General Conditions

These general terms and conditions of sale (“General Conditions”) govern the remote purchase of products made available through the website www.borgolacaccia.it  (“Website”), in compliance with Legislative Decree no. 206/2005 (“Consumer Code”) and Legislative Decree no. 70/2003 on electronic commerce.
The Seller is Borgo La Caccia – ENO CACCIA Cooperativa Sociale Società Agricola ONLUS, with registered office at Loc. Caccia 1, 25010 Pozzolengo (BS), Italy, PEC: enocaccia@legalmail.it , Tax Code 93024460177 – VAT no. 03065590980 (hereinafter the “Seller”). Before placing an order, the Customer must carefully read these General Conditions, available in the Website footer and during the ordering process. These Terms and Conditions apply to any purchaser, including professionals. Where the purchaser requests an invoice or acts as a professional, the provisions of the Consumer Code on the right of withdrawal and other rules applicable exclusively to consumers shall not apply.
Contracts concluded through this Website are governed and interpreted in accordance with Italian law.

2. Product, Event and Service Information – Selection and Orders

Products and services for sale can be found in the “Shop” section of the Website.
Images are for illustrative purposes only and may differ slightly from the actual product; the written description shall always prevail.
The sale of alcoholic products is permitted exclusively to persons over 18 years of age in Italy and to persons of legal drinking age according to the laws of the Customer’s country of residence for international purchases. By placing an order, the Customer declares, under their own responsibility, that they meet the legal age requirements.
The Seller adopts specific measures to verify the purchaser’s legal age and shall not be liable for false declarations. The purchasing process includes an age-verification system (age-check), which may involve age declaration, date of birth entry and/or additional checks, the results of which are recorded in IT logs solely to demonstrate compliance with legal obligations (see Privacy Policy at https://www.borgolacaccia.it/en/terminiecondizioni).
Providing false information may result in the inability to complete the order or in its cancellation. The Seller may also carry out further checks, including at delivery, by requesting a valid ID document. Completion of the order confirms, under the purchaser’s responsibility, that they are of legal age and aware that the sale of alcoholic beverages to minors is prohibited by law.
For services or in-person sales, such as tastings or similar events, the Seller may verify the consumer’s legal age, for example by requesting an ID document and/or a signed self-declaration.

Product information: Each product page contains basic information (price, quantity, type, alcohol content) and may include additional materials such as videos, tutorials and photos. Images may show the back label with statutory information.

Purchase procedure: After selecting a product/service, click “Add to cart”. Products/services in the cart display name, quantity, VAT-included price (and for services: date, time, location, type) and a delete option. After checking personal and shipping details, the Customer may confirm the purchase and proceed to payment. Once the order is confirmed and paid, it cannot be modified, supplemented or cancelled. Promotional codes and order notes may be added before order completion.
The contract is concluded upon order confirmation sent by the Seller via email.
Summary of steps: select products/services and add to cart; read and accept these Terms and Conditions and the Privacy Policy; complete checkout details; choose payment method; confirm order.

The Seller also organizes and markets experiential services and events (e.g. tastings and food & wine events) (“Services”). Services are provided exclusively to adults. The Seller may verify age at the event and deny access without refund if verification is not provided.
Services are provided on specific dates and times. Pursuant to Art. 59(1)(n) of the Consumer Code, the right of withdrawal does not apply to leisure services provided on a specific date or period.
Once booked, Services cannot be cancelled or modified, nor refunded, except as required by law or expressly stated on the Website.
The Seller may cancel, postpone or modify Services due to force majeure, organizational needs, adverse weather or failure to reach a minimum number of participants. In such cases, the Customer is entitled only to a refund or, where offered, rescheduling, excluding any further compensation.
Participants must respect schedules and proper conduct; the Seller may exclude participants in an altered state or with inappropriate behavior, without refund. Participation is at the Customer’s own responsibility.

3. Shipping

Shipping in Italy costs €9.00 VAT included for orders up to €60.00 VAT included and is free for orders of €60.00 or more.
Delivery is made within 48/72 hours, subject to delays due to holidays or extraordinary events. Delivery date or time cannot be selected.
If an order cannot be fulfilled, the Seller will contact the Customer to arrange cancellation and refund where applicable.
The Seller ships within the EU and to non-EU countries. Customs duties are borne by the Customer. If unpaid and shipment is refused or abandoned, shipping and customs costs will be deducted from the refund.
Prices include VAT unless otherwise stated. Shipping costs are shown during checkout. Products are delivered to the address provided. Risk passes to the Customer upon delivery.

4. Payment Methods and Invoicing

Accepted payment methods:

Credit/debit cards (Visa, Mastercard, American Express, Maestro, Diners, JCB);

PayPal;

Bank transfer (details provided on the Website);

Any other methods indicated on the Website.

Payment is charged at order confirmation. In case of cancellation, refunds are issued via the original payment method.

4.1 Invoicing
Professional customers may request an invoice by entering correct billing details during checkout. Invoices cannot be issued after the order is completed.

5. Right of Withdrawal

Consumer Customers may withdraw within 14 days from delivery, without stating reasons, except for the exclusions under Art. 59 of the Consumer Code (e.g. customized goods, perishable goods, sealed goods opened after delivery, alcoholic beverages under specific conditions, leisure services on a specific date).

. Products must be returned to the Seller’s address. Refunds are issued within 14 days after receipt of intact goods in original packaging. Return shipping costs are borne by the Customer.

6. Legal Warranty of Conformity

Products are covered by the legal warranty pursuant to Arts. 128–135 of the Consumer Code. Normal variations inherent to wine or honey (e.g. sediment, crystallization) do not constitute defects.
In case of defects, the Customer is entitled to replacement, price reduction or contract termination as provided by law. Any complaints should be sent to info@borgolacaccia.it.

7. Limitation of Liability

The Seller is not liable for improper use of products, false age declarations, courier delays, force majeure, or indirect damages.

9. Intellectual and Industrial Property Rights

All content on the Website (texts, images, logos, trademarks, software, etc.) is owned by or licensed to the Seller and protected by applicable laws. No rights are granted to Customers except as expressly permitted by law.

10. Governing Law and Jurisdiction

Italian law applies. For consumers, jurisdiction lies with the court of the Customer’s residence or domicile; for professionals, exclusive jurisdiction is Brescia.

11. Clauses pursuant to Art. 1341 of the Italian Civil Code

The Customer expressly accepts clauses 2, 4, 5, 6, 7 and 9.
